LA Wallet (“LA Wallet,” “we,” or “us”), owned and provided by Mobile DMV, LLC, is a digital platform that provides convenient smartphone/mobile device-based storage for legal digital versions of driver’s licenses and other state ID. Your privacy when using LA Wallet is very important to us. Therefore, this Privacy Policy describes what personal information we collect, and how we use, store, and share that information when you visit our website, use the LA Wallet application, or any other online services we offer (together, “Online Services”) that link to or reference this Privacy Policy. We also recognize that we have an ongoing responsibility to protect your personal information, so we may from time to time update this Privacy Policy as we undertake new personal data practices or adopt new privacy policies. Notice of any material changes or updates to this Privacy Policy will be posted on the homepage of our website and you will receive a pop-up notice in your account if you are using our LA Wallet application before any of those changes take effect. We will also change the “Last Updated” date at the top of this page.

Types of Information We Collect
To enhance user experience, we must collect information to operate, provide, improve, understand, customize, support, and market our Online Services. The types of information we collect depends on the Online Services you use. Our Online Services also include different features which, if used, requires us to collect additional information. Without collecting certain types of information, we may not be able to provide our Online Services or certain features of such services to you. Examples of the types of information we may collect include the following:
- Personal Information: Personal information is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual. We collect personal information you voluntarily provide to us when you visit or use our Online Services, express an interest in obtaining information about our Online Services, or otherwise when you contact us. Examples of personal information we may collect include the following:
- identifiers, such as information provided on government-issued identification like your name, postal address, Internet Protocol (“IP”) address, email address, health records, date of birth, organ donor status, weight, driving restrictions, credit or debit card or other financial information, or similar identifiers;
- information that identifies, relates to, describes, or is capable of being associated with a particular individual, such as physical characteristics or descriptions, a photograph, address, telephone number, driver's license or state identification card number, insurance policy number, medical information, or health insurance information;
- account registration information such as your username, email address, and password;
- sensitive personal information, such as your financial account number, debit or credit card number in combination with any required security or access code, password or credentials allowing access to an account, precise geolocation, racial or ethnic origin, or personal information concerning your health;
- biometric information including facial characteristics used or intended to be used, singly or in combination with other identifying data, to establish individual identity;
- device information including hardware model, operating system and version, preferred language, unique device identifier, serial number, Internet or other electronic network activity information, such as browsing history, or search history;
- crash and analytical usage data, which includes error reports and information about your activity while using our Online Services; and
- other information you provide to us, such as the content of the communications with us, including interactions with customer support.
- Non-Identifiable Data: When you use our Online Services, we may receive certain personally non-identifiable information. Non-identifiable information is a piece of data that cannot be used on its own to trace or identify a person. We may store non-identifiable information ourselves or it may be included in databases owned and maintained by our affiliates, agents, or service providers. This Privacy Policy does not apply to any aggregated information.
- Aggregated Data: We may collect aggregate information, which is information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Online Services and what other sites may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the website’s Uniform Resource Locator (“URL”) that points to the site you just came from, which URL you go to after visiting our Online Services, what browser you are using, and your IP address. We may share aggregated data with our affiliates, agents, and business partners. Additionally, we may disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes. This Privacy Policy does not apply to any aggregated information.

How We Collect Information
When you visit our Online Services, we collect personal information you give us directly, including information you allow us to receive from state authorities, as well as usage information, which we may collect automatically. Personal information we collect falls within the following groups of sources:
- Directly From You: We collect personal information you provide directly to us. For example, when you register for an account on our Online Services, interact with us through social media, add an identification card to LA Wallet, send us an email message or otherwise contact us, submit a form or transmit other information by telephone or letter, or submit your credit card or other payment information.
- From Third Parties: We collect personal information from third parties. For example, from businesses or third parties acting at your direction, from our affiliates who work with us to provide our Online Services and assist us in security and fraud prevention, and from other lawful sources.
- Cookies and Tracking Technologies: For more information on our use of cookies, please see Section 6 (Cookies) below.
- From Automated Information Collection: We may collect personal information automatically. For example, automated monitoring of our Online Services and other technical systems, such as our computer networks and connections, communications systems, and email and messaging systems for purposes of monitoring the security and reliability of our Online Services.

How We Use Your Information
We may use your information for the following business purposes:
- with your consent, to send you promotional communications and to contact you about requested services;
- to send you communications relating to your use of our Online Services, including confirmation emails, responses to your emails, support inquiries, submissions, comments, requests, or complaints;
- for offline secure caching of your credentials;
- to send you information on updates to our Online Services that better meet your needs;
- to enhance the operation of our Online Services;
- to statistically analyze the use of our Online Services
- to improve our service offerings;
- to customize our Online Services’ content, layout, and services;
- to deliver information to you and to contact you regarding administrative notices;
- to meet legal obligations;
- to troubleshoot problems;
- to protect our rights and property;
- to enforce our agreements with you, including our Terms of Sale, Terms of Use, and this Privacy Policy;
- if we otherwise have your consent; or

How We Share Your Information
We do not sell, trade, or rent your personal information to others, and your personal information will not be sold, traded, or rented for the purposes of marketing. We may, however, share your personal information in the following situations:

Vendors, Consultants, and other Third-Party Service Providers: We may share your personal information, to the extent necessary, with
third-party vendors, service providers, contractors, or agents who
perform certain business-related functions for us or on our behalf and
require access to such information to perform those functions. These
third parties cannot use the personal information we share for their own
purposes, and they must delete or return the personal information once
they have fulfilled our request. Examples of business-related functions
that our service providers perform include, but are not limited to the
following:
- payment processing;
- data analysis;
- email delivery;
- identity verification;
- hosting services; and
- customer service and marketing efforts.
- Our Affiliates: We may share your personal information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
- Business Transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, financing, reorganization, dissolution, acquisition of all or a portion of our business to another company, or any similar event relating to all or a portion of our business or assets.
- Legal Requirements: We may disclose your personal information if we are required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend our rights or property, (c) act in urgent circumstances to protect the personal safety of users of our Online Services or the public, or (d) protect against legal liability.
- Consent: We may disclose your personal information for any other purpose with your consent.

Our Online Services may contain links to other websites that are not operated by us. We do not endorse, authorize, represent, or exercise control over third-party websites. These other websites may place their own cookies or other files on your computer, collect information, or solicit personal information from you. Third-party websites follow different rules regarding the use or disclosure of the personal information you give them. We strongly advise you to review the privacy policy of every website you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. By visiting a third-party website or third-party link, you acknowledge that you understand and assume these risks.

Cookies
Depending on how you use our Online Services, we may store “cookies” and other tracking technologies such as web beacons on your device to collect certain aggregate data about you, customize certain aspects of your specific user experience, help us better understand user behavior, and for security and fraud prevention purposes. A cookie is a small data text file stored on your computer or device that uniquely identifies your browser. We may use the following cookies:
- Strictly Necessary Cookies: These cookies are set as required to provide a specific feature or service that you have accessed or requested; for example, remembering your login credentials.
- Analytical or Performance Cookies: These cookies are used to track visitors and their user behavior. This data is then used to improve the way our Online Services work and in turn, used to improve user experience.
- Security and Authentication Cookies: These cookies keep our Online Services secure by managing user sessions and preventing fraud. They ensure that your information is delivered to you by linking your information with a unique cookie identifier string.
- Personalization Cookies: We use these cookies to remember your preset features and preferences for our Online Services.
If you prefer that we not use cookies, we provide you with the means to disable their use. If you want to disable cookies and you are using the Safari web browser, choose “Block all cookies” in Safari’s privacy settings. If you are using Google Chrome, choose “Block third-party cookies” in Google Chrome’s cookies and site permissions settings. If you are using any other browser, or you have questions about your browser’s cookie settings, contact the applicable browser support team.
Certain features of our Online Services may not be available if all cookies are disabled.

Online Tracking
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

Communications
Communications between us may occur electronically, whether it be through messages to your LA Wallet account, email, text (SMS) message, notices posted on our website or applications, or push notifications (together, “Communications”). Therefore, when you use our Online Services or otherwise register to receive services, you may be asked to provide an email address, phone number, or other personal information along with a request to consent to the receipt of Communications. If you consent to receiving Communications, you are agreeing to be contacted by or on behalf of us through the Communication channels listed above.
- Content of Communication: Communications from or on behalf of us to your mobile phone or other wireless device may include, but are not limited to user support, legal notices, and information about new products or services.
- Text Messages: If you consent to receiving text messages, you understand that the number of text messages you receive from us may vary, and that message and data rates may apply based on your plan with your wireless provider. Your consent is not a condition for purchase. You understand and acknowledge that network services are outside of our control, and we are not responsible or liable for issues caused by delays or failures in the receipt of any mobile messages connected with our text messaging services. Mobile access and text message delivery is subject to your mobile carrier network availability. Therefore, such access and delivery are not guaranteed. Your wireless service provider/network operator is not liable for delayed or undelivered mobile messages. If you have any questions about your text or data plan, please contact your wireless provider.
- Florida Residents: We strive to comply with the Florida Telemarketing Act and the Florida Do Not Call Act as applicable to Florida residents. For purposes of compliance, you agree that we may assume that you are a Florida resident if, at the time of opt-in or consent to text messages, your shipping address, as provided, is located in Florida or the area code for the phone number used to opt-in is a Florida area code. You agree that the requirements of the Florida Telemarketing Act and the Florida Do Not Call Act do not apply to you, and you shall not assert that you are a Florida resident if you do not meet either of these criteria or, in the alternative, do not affirmatively advise us in writing that you are a Florida resident by sending written notice to us. If you are a Florida resident, you agree that mobile messages sent in direct response to mobile messages or requests from you (including but not limited to responses to Keywords, opt-in, help or stop requests, and shipping notifications) shall not constitute a “telephonic sales call” or “commercial telephone solicitation phone call” for purposes of Florida Statutes Section 501 (including but not limited to sections 501.059 and 501.616), to the extent the law is otherwise relevant and applicable.

Access to Device Features:
(i) Camera: LA Wallet may ask you for consent to access your mobile device's camera. The camera may be used in the process of adding a credential or in using the VerifyYouTM scanner for verification purposes. Your camera may also be used when submitting a request for user support.
(ii) Bluetooth: LA Wallet may ask you for permission to use Bluetooth on your mobile device. Bluetooth is used when you choose to share your ISO 18013-5 compliant mobile driver’s license (“mDL”) to an authorized mDL reader device. You can read more about the ISO 18013-5 mDL standard here.

Opting-Out
Consenting to Communications or access to features on your device as stated in Section 8 above is completely voluntary. You have the right to refuse Online Services, and the right to opt out of receiving promotional Communications, and the right to refuse access to features on your device at any time.
If you want to stop receiving promotional Communications via email, you may update your preferences by using the “Unsubscribe” link found in our emails.
You can opt out of promotional texts by replying the keyword “STOP.” After you send the text STOP to us, we will send you a text to confirm that you have been unsubscribed. After this, you will no longer receive text messages from us. You can also opt-out of promotional emails and texts by contacting us by email, phone, or in writing with your request. Regardless of your opt-out preferences, we reserve the right to send you emails or other communications for administrative, operational, and emergency purposes.
To stop the use of your camera, you will need to go to your device’s settings and change the app permissions. The process for changing app permissions may not be the same for every device. Therefore, please contact the support team for your device if you need help changing app permissions.
If you want to disable push notifications, you will need to go to your device’s settings and change the notification permissions. The process for changing notification permissions may not be the same for every device. Therefore, please contact the support team for your device if you need help changing notification permissions.

Updating and Correcting Information
We believe you should have the ability to access and edit the personal information you have provided to us. You may change personal information in your account, where permitted, at any time by following the instructions posted in your account. You may also correct your personal information and privacy preferences by emailing us at [email protected]. Please include your name, address, and email address when you contact us. We encourage you to promptly update your personal information if it changes.

Removal or Deletion of Information
You may ask to have the information on your account deleted or removed. However, some information, such as past transactions, logs of technical support calls, or other information may not be deleted for legal or administrative purposes. In addition, it may not be possible to completely delete your information without some residual information because of backups. To have your personal information deleted or removed, to the extent we are able to do so, please contact us at [email protected].
Please note that if you decide not to provide us with certain personal information we request, or you decide to delete or remove your personal information, you may not be able to access some or all of our Online Services.

Your Role in Protecting Your Information
To protect your information and our proprietary databases and systems, you should not share any of your personal information with any unauthorized persons. You should take all necessary steps to secure your mobile devices and the information you may have stored on them. We do not have control over the security of your mobile device. We assume no responsibility for the loss of information associated with security disrupting technologies, including, but not limited to reverse engineering of mobile device applications or malware that compromise our Online Services as a result of owner or third-party initiated changes to your mobile device. The security of your devices is solely your responsibility.
Any information you provide, comment, or otherwise post on or to any public areas of our Online Services (including any social media platforms) shall be deemed “Public Information.” Your Public Information is non-confidential, and we reserve the right to reproduce, use, disclose, and distribute such Public Information to others without consent, limitation, or compensation of any kind. Also, your Public Information may be viewed, collected, or accessed by other users of our Online Services, and may be available in search results on Internet search engines.
Please do not post or add personal data to any public areas on our Online Services that you would not want to be publicly available. To request removal of your Public Information please feel free to contact us at [email protected]. However, please note that in some cases we may not be able to remove your Public Information from such areas. You understand and acknowledge that posting any Public Information is at your own risk. Although we have put in place reasonable security measures to protect your personal information, we cannot control the actions of other users or members of the public who may access your Public Information and are not responsible for the circumvention of any privacy settings or security measures you or we may have in effect.
You further understand and acknowledge that, even after removal of any Public Information, copies of such information may remain viewable in cached and archived pages or if any third parties have copied or stored such information. Therefore, we advise that you do not upload, comment, or otherwise post any information you do not wish to be public.

Data Integrity and Security
We process your personal information only for the purposes for which it was collected and in accordance with this Privacy Policy and any other applicable notices. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on you to update or correct your personal information whenever necessary. You accept full responsibility for ensuring your personal information is accurate and complete to the extent that you choose to provide your personal information.
We take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction, including through restriction of access to personal information to our employees, contractors, agents, and consultants who need to know that information in order to operate, develop, or improve our Online Services. These steps include internal reviews of our data collection, storage, and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal information. Unfortunately, however, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge and understand that there are security and privacy limitations inherent to the Internet beyond our control, and the security, integrity, and privacy of any and all information and data exchanged between you and us through our Online Services cannot be guaranteed.

Retaining Your Information
Facial biometric information is retained by our systems for no longer than twenty-four (24) hours. However, we will retain all other personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies. We will also retain usage data for internal analysis purposes; although, usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Online Services, or we are legally obligated to retain this data for longer time periods.

Minors
We do not knowingly collect, use, disclose, or solicit personal information from anyone under the age of fifteen (15) or knowingly allow such persons to create an account on our Online Services. If we become aware that we have collected personal information from a child under fifteen (15) we will take steps to delete such information and the child’s account.

Data Transfers
We maintain our servers and technical infrastructure in the United States (“U.S.”). If you are accessing our Online Services from another jurisdiction, please be aware that your information may be transferred, stored, and processed in the U.S. and in accordance with this Privacy Policy. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

We may update our Privacy Policy from time to time.
